John B Kleba

 

Biography

Dr. John Bernhard Kleba studied Political Sociology at the Federal University of Santa Catarina, South Brazil, and obtained a doctoral degree in Social Sciences in Dec 2000, at the Institute for Science and Technology Studies (IWT), University of Bielefeld, Germany. Since March 2005 he is a Senior University Lecturer of Political Science and Sociology at the Aeronautics Technological Institute (ITA), São José dos Campos, São Paulo, Brazil.

 

He is currently working in a post-doctoral research project on the regime of access and benefit sharing of the Convention on Biological Diversity, as visiting fellow at the CSGR & Department of Law, with Prof. Dwijen Rangnekar, Warwick U, UK.

 

With Sandra A. K. Kishi he is the editor of a Brazilian anthology on social and legal issues concerning access to genetic resources and traditional knowledge, and organized an international workshop on the issue, in São Paulo on Sept 17th and 18th, 2009.

The Post-doctoral research project

This research focuses on the implementation of the access and benefit sharing regime of the Convention on the Biological Diversity (CBD). It departs from the view that conventional institutional tools (e.g. bilateralism; intellectual property rights system; fairness reduced to deal contracts) are unable to achieve strong outcomes. Whereas the CDB relies upon a state-individualistic approach, genetic resources, associated traditional knowledge and bio-information are often disseminated across the borders of nations and cultures, raising problems of transnational governance. Transboundary dimensions are here addressed through the concepts of bio-knowledge pools, social and policy networks and institutional innovations. Tensions in the links between the transnational and the local dimensions, as well as in the property and access regimes across the communal, the private and the public are discussed.

One focal research issue investigates how “fairness and equity”, core claims of the CBD and the recent Nagoya Protocol, are constructed in ideology, law and practice. The other study focuses on socio-legal innovations which address the transborder dimensions of access and benefit sharing-issues seeking solutions to the fine balance between achieving fairness and improving efficiency of access.
