Principal aims

From an international economic law perspective, two features characterise the current process of globalization: restructuring of international institutions and the persistent erosion of the traditional boundaries that divide public and private international law. These two features have brought about momentous changes that are redefining the nature and shaping the behaviour of states, international institutions and multinational companies. The first part of the Core Course is thus designed to offer a critical overview of these developments and to provide students with the conceptual tools to understand what can be described as the legal foundations of the contemporary world economy. A special concern of the course is to understand the various regulatory frameworks, formal and informal, that govern international economic relations. Accordingly, emphasis is placed upon the interpenetration between national and international law and upon the cultural, political and economic aspects that have a bearing on the resolution of international economic disputes. The second part of the Core Course examines the procedural issues governing resolution of international commercial disputes. Topics covered include international jurisdiction of national courts, choice of law in international disputes, international judicial assistance and provisional remedies in civil cases, recognition and enforcement of foreign judgments, and international commercial arbitration.
