Chair: Amanda Wilson, University of Warwick Law School

Title: 'Aristotle’s Prison: A Search for Humanity in Tragic, Punishing Places'

Abstract: Dostoyevsky described his experience in Omsk prison camp in Siberia as ‘morally unbearable’. Prisoners in some contemporary long-term, high-security prisons have started to use similar, deeply meaningful language. What makes prisons unbearable? In what way are they experienced morally? What might ‘morally bearable’ punishment look like? In this seminar, I talk about my new book, Aristotle’s Prison: A Search for Humanity in Tragic Places, drawing on data from some least and most survivable prisons, and a few exceptional best practice outliers, to explain why prisoners are so adamant in their descriptions of the best and worst kinds of prisons. They contrast ‘deserts’ with ‘oases’. In a striking parallel with Aristotle’s thinking about city states and their relationship to the human soul, research shows us that only when prisons can become ‘morally intelligible’ – fair, decent and humane enough – do they become ‘morally enabling’. Most are not, but instead increasingly generate gratuitous and destructive forms of suffering. Can there be such a thing as ‘just punishment’ when we create such prisons?

Chair: Daniel Matthews, University of Warwick Law School

Title: 'Consumer Law without the consumer? AI Agents, and humans-in-or-out-of-the-loop'

Abstract: 'As AI dominates policy and legal debates, the focus is increasingly turning to AI Agents, i.e., applications built on AI that can automate actions typically undertaken by humans. Unlike robotic automation, which mostly replaced or supplemented mechanical actions, AI agents seek to replace humans in important decision-making processes. Consumer-focused AI agents are a key example: several of these have started to appear (e.g., Muse), but early reports suggest that they suffer from reliability problems. The basic idea of AI agents seems attractive, but it raises questions as to what exactly the implications would be for human consumers to step back from taking decisions themselves that can affect their economic interests and privacy. This paper focuses on the implications of taking human consumers out of the decision-making loop and considers the implications for consumer law, as well as for human consumers who wish to remain in the loop. Although the focus is on consumer law, the issues discussed are of wider relevance to AI-driven automation'

Where: S0.21

Global leaders and international stakeholders are meeting for COP31, the 31st Conference of the Parties to the UN Framework Convention on Climate Change (UNFCCC) in Antalya, Türkiye in November 2026, at a time when multilateralism and international law are facing significant geopolitical and economic crises and fragmentation. Escalating military conflicts, rising energy vulnerabilities, trade and financial shocks, and intensifying competition over trade, technology and critical resources are reshaping the political space for cooperation and the material capacity of states to deliver ambitious climate action. These pressures are particularly acute for developing countries, which confront rising climate impacts alongside constrained access to affordable finance, technology and policy space.

This lecture examines what is at stake for the UN climate process in this challenging global context, especially for countries and communities who are least responsible for, but who bear the greatest impact of climate change. The lecture will consider the main issues at stake in Antalya, what challenges will be confronted in negotiation halls and beyond, and the role and importance the multilateral climate regime in the current global context.

Title: 'Decolonising Strategic Litigation Scholarship: Leading with Refugees’ Justice Frameworks'

Abstract: In this work in progress presentation, Saba and Kate explore the concept of and possibilities for decolonising strategic litigation scholarship. They focus on domestic and international strategic litigation that targeted Australia’s offshore detention regime. But rather than starting with the different types of litigation and the causes of action involved, they begin with refugees formerly detained in these centres. Through semi-structured, qualitative interviews, Saba and Kate foreground refugees’ framings of seeking asylum, detention and offshore processing. They then consider whether the domestic and international litigation that directly addressed Australia’s offshore processing regime aligned with refugees’ conceptualisations of justice and injustice.

This research focuses on female and transgender refugees from Iran formerly detained in Australia’s offshore processing centre in Nauru. While men detained in Australia’s offshore processing centre on Manus Island (Papua New Guinea) produced celebrated memoirs and documentaries, artistic outputs and advocacy by women and girls detained in Nauru have not attracted the same level of attention or acclaim. There are reports that document the harms women suffered in offshore detention, but in this study Saba and Kate move beyond documenting refugees’ ‘experiences’ and ‘trauma’ to exploring their intellectual and political analyses on issues such as authoritarian regimes, misogyny, discrimination, persecution, exile, incarceration, hierarchies of power and law and justice. In doing so, Saba and Kate contribute to both the emerging push for refugee-led research in the field of refugee studies as well as the scholarship on strategic litigation that purports to focus first and foremost on clients’ interests but only does so within existing doctrinal boundaries.

This research is funded by the Australian Research Council: ‘Mobilising Litigation to Effect Legal, Policy and Social Change’, Australian Research Council Discovery Early Career Award and Fellowship DE240100652.

Title: 'Arctic, Autonomous, Artificial: Thinking of Normative Climate Exosomatisation'

Abstract: As the material premises of polar order withdraw because anthropogenic climate change, technological proposals have appeared to manufacture the environment, to re-create the conditions for flourishing ecosystems, and broadly to help in the fight against the worst of the climate crisis. In essence, what these proposals seek to do is to manufacture the substrate that governance has always presupposed with the promise to hold in place the body on which the law is set to rest. This paper reads that promise through Bernard Stiegler’s idea of exosomatisation, the externalisation of vital functions into technical organs, and argues that such interventions also externalise normativity. For instance, The freeze-thaw cycle of Arctic sea ice already performs normative work of certain kind. It times passage, distributes access, sets thresholds into space before the law, or rather before legal temporalities, can exist. When autonomous technologies take over that cycle, the normative ability migrates with them, and the scientific and technical knowledge about how much ice there ought to be, where, and for whom, becomes inscribed into infrastructure that executes it continuously, without deliberation and without a subject.

This paper argues that this a conceptual mistake to think of geoengineering governance, and all its ramifications, as being about the legal regulation of a new technology. Rather, it is more effective to understand it a contest over where normativity resides and whether autonomy, read as auto-nomos, can be recreated artificiality where the nomos derives not from a subject but by a made thing. The instinct at this point is often to work against the artifice, as if an autonomous nature had been surrendered to machines. In that respect, the paper also reads exosomatisation through the additional theoretical lens of Xenofeminism to suggest that nothing about autonomy was ever natural. The planet to which law would defer is already an object in which artificiality is the condition of planetary governance. To defend a self-regulating earth system against its artificial double is potentially the most counter-productive naturalising move.

Title: Judges Appointed by Lottery: A Solution to a Legitimacy Deficit?

Abstract: In response to the well-known crisis of liberal democracy, democratic theorists have proposed ‘democratic innovations’ as a way of creating meaningful opportunities for citizen representation, participation, and deliberation. Among such innovations are ‘deliberative mini-publics’ (DMPs), which are randomly selected groups of citizens that come together to collectively debate issues of public concern, making decisions that either become binding or merely advise other lawmaking authorities. While most mini-publics have been conceived as auxiliary bodies that issue recommendations to either the executive or the legislature, there have been proposals to design DMPs which are integrated into the judiciary and have the power to make judicial decisions. These forums, called ‘constitutional juries’, would not only evaluate evidence to decide whether accused parties are guilty or innocent in criminal cases (as a trial jury would), but also determine bill-of-rights issues (as a constitutional court would). Whilst no proposal to confer judicial powers upon citizens has been implemented, two initiatives in Italy and Switzerland have sought to change the mechanism to appoint judges, shifting from a system where judges are designated by state authorities or a judicial council to one where they are randomly selected. Although crucially different in nature, both initiatives could be taken as a testament to the crisis of legitimacy facing judges, who often fail to legitimise themselves in the eyes of citizens. In light of these theoretical and empirical developments, this project seeks to understand the implications of the idea of appointing judges by lottery for the legitimacy of the judiciary.

Title: 'Digital ID Infrastructure, Health Access and the Case for a Derivative State Duty'

Abstract: Digital identity systems increasingly mediate access to essential services, yet their role in health access is often treated as a technical or privacy concern rather than one of rights and accountability. I conceptualize digital ID infrastructure as a proximate mediator of health access, showing how enrollment, biometric authentication, database linkage, and AI-enabled analytics can determine recognition and admission to care. These risks are especially acute for people in HIV key populations subject to criminalizing laws, for whom identification may intensify exclusion, exposure, and deterrence. Drawing on the rights to health and science, nondiscrimination, non-retrogression, and due diligence under the International Covenant on Economic, Social and Cultural Rights, I trace the contours of a derivative state duty concerning digital ID-mediated health access. When states make identity infrastructure a condition of care, human rights accountability must extend to its design, operation, safeguards, remedies, and delivery by private actors.

Location: MS.04 Zeeman building

Abstract

The Next Fix: the future of drugs is here, and it’s dangerously unequal.

Over the last decade, the status quo around drugs has collapsed. Drugs once sold as safe cures have been revealed as ineffective or dangerous, while substances criminalised for generations are being reborn as breakthrough mental health treatments, wellness supplements, Silicon Valley productivity tools and billion-dollar investment opportunities. How did this reversal happen – and who stands to benefit?

Tracing one of the most significant legal shifts happening across the globe at the moment, in this presentation I will explore what changing drugs laws means for our understanding of the direction of travel for late-stage capitalism.

Professor Kojo Koram is Professor of Law and Political Economy at Loughborough Law.

Where: Online

If you’re considering a career in law, AllAboutLaw’s Virtual Law Fair runs from 19th–23rd October. With 65 sessions to choose from, the Fair is an opportunity to hear directly from firms and Prepare with Insight. It can help you:

understand what firms actually look for

strengthen your applications

prepare for interviews and assessments

discover firms and opportunities that might suit you

make more informed career decisions

And there’s a strong reason to get involved: last year, AllAboutLaw members who secured a vacation scheme or training contract attended around 50% more AllAboutLaw events than those who didn’t.

Browse the programme and book the sessions most useful to you here: AllAboutLaw Virtual Law Fair 2026

Places are limited for individual sessions, so it’s worth taking a look now.
