When we talk about "immigration responsibilities," we’re referring to the duties and obligations that individuals, governments, or organizations have in relation to immigration processes.

The meaning can vary depending on the context; in this video we’ll explore the immigration responsibilities

that apply to you, as our student, and the University, as a student visa sponsor

The University’s immigration responsibilities as a Student Visa sponsor are dictated by the Home Office, a ministerial department of the UK Government

To meet our record keeping responsibilities, the University must hold copies of your immigration permission and where appropriate, evidence of your date of entry to the UK.

We’re required to hold your current UK contact telephone number and address which must be updated if either change.

If your CAS included details of any academic qualifications or if your course required ATAS clearance, then we must have this information on record also.

You can help the University satisfy these requirements by telling us if you change or extend your visa, if you move house or get a new phone number.

The University is obliged to inform the Home Office of any changes to our visa-sponsored students’ circumstances.

This includes if you change your course or your study location, complete your course earlier than expected or take a break in studies.

If you withdraw from your course. If you restart on a different course, or if you change into a different visa category so you no longer require a Student Visa.

We will also notify the Home Office if we withdraw visa sponsorship due to poor attendance or engagement,

non-payment of tuition fees, or if we become aware that you’ve breached the conditions of your visa.

Now let's take a look at some of your responsibilities – these will apply to you unless you’re a UK national, even if you don’t hold a Student Visa sponsored us.

You’ll need to update the university of any changes to your personal data so we can ensure your records are accurate;

this includes changes to your name, UK address, phone number and personal email.

In addition, we need to know about any changes to your identity documents, so when you get a new passport or obtain a second passport with a  new nationality,

if you extend your current visa or switch to a different visa category. For updates such as these we’ll usually ask for a copy of the new document.

You’ll also need to inform the Home Office by updating your UKVI account online should any of your personal details change

since your visa was granted, these include your name, gender, UK address, phone number and email.

Changes to your identity documents, such as a new passport, or the addition of second passport for dual nationals

Another very important responsibility is that you engage with your course.

As your education provider the University expects you be an active participant in your own learning journey,

by completing enrolment in time for the start of your course and attending scheduled lectures and seminars.

Research the course content and take time to prepare so you are ready to participate in group teaching.

Attend exams, submit assessments on time and most importantly, raise any questions or concerns you might have during your personal tutor meetings

It’s your responsibility to be aware of what your visa allows you to do, or your ‘immigration conditions’

The term Immigration conditions" refers to the rules and restrictions attached to a person’s permission to enter or stay in the country.

These conditions are set out in the UK Immigration Rules and vary depending on the type of visa or immigration status a person holds

 – it’s your responsibility to be aware of what your visa allows you to do.

Student visa holders will have a condition which restricts how many hours can be worked, and the type of employment which is permitted.

Other visa types may have other work conditions

Study conditions relate to the course for which a Student Visa was granted, meaning it can usually only be used to study the course for which it was issued

Most time limited visas restrict the holder from accessing public funds, such as housing benefit

and all forms of temporary immigration permission have an expiration date, which is the date by which the holder either needs to leave the UK or apply for further leave

Let’s look now at what not abiding by your visa conditions might look like

Academic non-engagement -this is where you don’t study or fail to engage with the course for which your Student Visa was granted.

Unauthorised employment -working more than the permitted number of hours or in an occupation not permitted.

Overstaying - remaining in the UK after your visa has expired or not applying for further leave.

Claiming public funds - claiming money from the state that you are not entitled to.

Breaching UK laws and regulations - visa holders must also comply with all UK laws and regulations, including criminal laws.

All of these examples could result in the university withdrawing you from your course and curtailment of your warwick-sponsored Student Visa by the Home office.

Depending on the nature and severity of the breach, you could receive a fine or be liable for removal,

face a time-ban on re-entry or have future UK visa applications refused.
