SOFTWARE LICENCE AGREEMENT

This Agreement applies to all of the SOFTWARE including

• ADEM
  • Fireblight
  • Nectria
  • Powdery Mildew
  • Scab
• PESTMAN
  • Codling
  • Pear Psyllid
  • Tortrix
• Slug
• MORPH^TM Software environment within which the Software programs (Models) operate.

1. GRANT OF LICENCE

This Agreement permits you to use and make copies of the SOFTWARE programs solely for your own internal use provided each copy is used only on a single computer and by the same one user. The user may not use the SOFTWARE to provide services to any other person or organisation without the prior written agreement of terms with Warwick-HRI (“WHRI”). The SOFTWARE is in “use” on a computer when it is loaded into temporary memory (ie. RAM) or installed into permanent memory (eg. hard disk, CD-ROM, or other storage device) of that computer.

2. COPYRIGHT

The SOFTWARE (including any images, “applets”, photographs, animations, video, audio, music, and text incorporated into the SOFTWARE) contains proprietary information and copyright information owned by the HDC, Department for Environment Food and Rural Affairs, (“defra”), WHRI and other organisations and is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE like any other material that is legally protected by Copyright. You may not copy any printed materials accompanying the SOFTWARE.

3. OTHER RESTRICTIONS

You may not rent or lease the SOFTWARE, and you may NOT transfer the SOFTWARE and accompanying printed materials on a permanent basis. You may not reverse-engineer, decompile, or disassemble or reconfigure the SOFTWARE in any way. If the SOFTWARE is an update or has been updated, any transfer must include the most recent update and all prior versions.

LIMITED WARRANTY

NO WARRANTIES. To the maximum extent permitted by applicable law, the HDC, defra and WHRI expressly disclaim any warranty for the SOFTWARE. The SOFTWARE and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability or fitness for a particular purpose. The entire risk arising out of use or performance of the SOFTWARE remains with the user.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by applicable law, in no event shall the HDC or defra or their suppliers or WHRI, be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use or inability to use this product, even if the HDC, defra or WHRI have been advised of the possibility of such damages.
