CJC member Laurène Soubise's paper published in Criminal Law Review

Laurène Soubise's new article on prosecutions in the magistrates' courts has been published in the November edition of the Criminal Law Review. Titled 'Prosecuting in the Magistrates' Courts in a Time of Austerity', the paper is based on Laurène's doctoral research project. The following is a brief blurb describing the paper:
Summary proceedings in the magistrates’ courts have always been a quicker and cheaper way to process minor criminal cases, compared to trial by jury at the Crown Court. Research studies have shown how defence lawyers have made those cases routine so that they could be processed rapidly and cost-effectively through the system. However, there has been little research on how the Crown Prosecution Service (CPS) deals with magistrates’ court cases. Basing its analysis upon direct observations and interviews with CPS staff, this paper examines the impact of efficiency concerns and recent budget cuts on the way cases are prosecuted by the CPS at the magistrates’ court. It shows how, taking advantage of routinised defence practices, most of the CPS magistrates’ court advocacy has been delegated to Associate Prosecutors (APs). This delegation to less-qualified personnel reinforces the bureaucratisation of summary justice as it is based on decisions being made in the prosecutor’s office, instead of open court. In practice, oversight by Crown Prosecutors is limited as the constraints of court advocacy run against the rules governing APs powers.

Professor Jackie Hodgson talks current affairs on BBC Radio and BBC World Service’s Newshour

Professor Jackie Hodgson spoke live on BBC Radio 4 on November 2, 2017, about the recent events in Catalonia. Professor Hodgson was asked by BBC Radio 4’s Eddie Mair on the PM news program whether Spain could issue a European Arrest Warrant (EAW) to secure the return of Carles Puigdemont in order to appear before the Spanish court. Professor Hodgson explained that whilst this was a politically charged situation, this would not prevent the extradition of Señor Puigdemont and colleagues, provided that the Spanish legal authorities could demonstrate their intention to bring criminal charges.

Professor Hodgson made a second radio appearance on November 4, 2017, when she was interviewed on the BBC World Service’s Newshour during which she explained the nature of the European Arrest Warrant and the strong grounds that would be required in order to resist its execution.

Screening of "Fallout" hosted by Warwick's CJC

On November 03, 2017, Warwick's Criminal Justice Centre hosted a screening of the documentary film ‘Fallout’ which examines the stories of four different people who were wrongfully convicted and imprisoned for serious offenses. The film was followed by a panel discussion involving Paddy Hill and Robert Brown, both wrongfully convicted of murder and who spent, respectively, 16 and 25 years in prison. The film's director Mark McLoughlin, as well as CJC researcher Dr. Juliet Horne and Jodie Blackstock from JUSTICE, spoke at the event. The discussions shed much-needed light on the often traumatic afterlife of those freed from prison following the admission of a miscarriage of justice.

CJC Director Dr Ana Aliverti wins prestigious Philip Leverhulme Prize in Law

The PLP is awarded to scholars who have made and continue to make significant and original contributions to knowledge in their field of research, and who have influenced their field sufficiently to have had an international impact. In 2017, up to 30 awards were made to UK-based outstanding research scholars within six subject areas. Ana won one of the five Prizes for Law. Congratulations to Dr. Ana Aliverti!

Jackie Hodgson chairs JUSTICE conference panel

Prof Jackie Hodgson chaired the criminal justice panel on 13 October 2017. The session included presentations on trafficking, legal privilege, and extradition post Brexit. Jackie is an elected member of the JUSTICE council.
