Transitional Justice and Stabilisation: Risks or Opportunities? - Alex Wilks, Justice Adviser, Stabilisation Unit, UK Government

Abstract:

In the aftermath of conflict, an area of focus for stabilisation is the need to increase the political space and build the confidence required for the negotiation and eventual establishment of an enduring political settlement. In that context, transitional justice needs to deal with messy political dynamics between bargaining elites and the absence of a coherent process, often balancing demands for accountability with the realities of political feasibility. A key question is therefore: how do we deal with the difficult questions and inevitable trade-offs and manage expectations, yet still develop credible and realistic mechanisms that support both short-term stability and longer term peacebuilding and development efforts?
