Guest Speaker: Professor Christian Twigg-Flesner, Warwick Law School
Title: (Work-In-Progress) 'Algorithmic Consumer Contracts and the European Law Institute's Guiding Principles and Model Rules'
Abstract: Following the recent advances in AI technology, there is renewed interest in harnessing the technology for the development of applications to automate aspects of the contract life-cycle, especially the automatic conclusion of some contracts. There is a reasonable prospect that consumers will be able to utilise a variety of ‘digital assistants’ to automate routine contracts in the future. Invariably, this raises new challenges for consumer protection. The European Law Institute has developed Guiding Principles and Model Rules on Algorithmic Consumer Contracts, which will be published in the first half of 2025. Christian is co-reporter and ‘person-with-the-file’ for this project. He will provide an overview of the Model Rules and discuss the novel approaches to regulation adopted by ELI. In particular, the focus will be on the integration of technology into the regulatory toolbox, i.e., utilising technological means as an instrument of consumer protection. This is an interesting example of how regulation by technology can go hand-in-hand with regulation of technology in giving effect to key policy objectives.
