‘Consent, Culpability, and the Law of Rape’

'Drafting criminal statutes is difficult. While theorists debate what consent "really is”, legislators may want to craft a different rule to shift social norms. This lecture discusses the best philosophical conception of consent, the reasons to craft a different legal rule, and the culpability puzzles that arise when the legal formulation departs from the best moral account'

Kimberly Kessler Ferzan is the Harrison Robertson Professor of Law and the Joel B. Piassick Research Professor of Law at the University of Virginia. She is widely published in criminal law theory, and is the co-editor-in-chief of Law and Philosophy. Professor Ferzan is an advisor to the American Law Institute’s project to redraft the Model Penal Code sexual assault provisions. She is a former federal prosecutor.
