This project seeks to the examine impact of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) by ascertaining the views of industry experts and policy makers at both national and international level. The project has 3 aims. The first aim is to undertake a retrospective analysis of how industry conveyed its views on intellectual property rights to government negotiators during the Uruguay Round. In particular, it will examine how industry trade associations successfully linked trade to intellectual property and secured the issue on the GATT policy agenda. The second aim is to examine current problems encountered by international companies during implementation of TRIPS. These problems are likely to include, for example, the speed and enthusiasm with which member countries are willing to adapt national legislation to comply with TRIPS. The third aim is to make policy recommendations, setting out the most appropriate institutional routes to ensure that industry views are appropriately considered in the international policy arena. This task will involve, for instance, assessing whether the TRIPS Council sufficiently utilises industry experience expertise in its review of the implementation of intellectual property protection measures in member countries.
