Title: 'What is Global Data Law? A Data Justice Perspective'

Abstract: In the past few years, Global Data Law has emerged to cover a variety of domains, from data protection, data sharing, data access, digital trade regulation, data governance frameworks, and AI regulation. With these developments, questions around how to think about data, how to govern its infrastructure, and determine its control, use and value become critical because of the power data has to affect as well as influence socio-economic developments.

As many visions for Global Data Law are proposed, including by international organizations, private enterprises, and nation states, an increasing challenge is to surface the frictions that constitute Data Law models, as they take on a ‘global’ character in legal, policy and infrastructural forms.

This presentation will discuss different proposals, vocabularies and forms that Global Data Law has taken, and examine the faults around which proposals converge and conflict. Thereafter, it will explore debates on data justice, which highlight the structural inequalities around datafication and the implications this has for people in terms of representation, autonomy, and the capability to participate in a digital economy. Finally, the presentation will offer a proposal for what Global Data Law could look like if studied from a data justice perspective.
