Title: (Work-In-Progress) 'Does Parliamentary Privilege Bind Public Inquiries?'
This paper discusses whether statutory public inquiries, convened under the Inquiries Act 2005, are bound by the doctrine of Parliamentary Privilege. As the doctrinal position is uncertain, the paper goes on to consider the normative position, concluding inquiries should not be so bound. Inquiries have gradually come to play an important role in our constitutional landscape, one that is only now receiving explicit attention. Examination of this issue on the twentieth anniversary of the Inquiries Act 2005 is apt. The doctrine of Parliamentary Privilege constitutes an undesirable barrier to important functions served by statutory inquires.
