Intergenerational Benefits for Indigenous people from resource development – Sustainable or Legally limited?

Abstract:

Benefits management structures which receive funds for Indigenous Peoples from resource development raise significant intergenerational, tax and governance issues. How should structures sustain benefits for future generations and match the long lifespan of many resource projects, yet also balance flexibility with sound governance, and meet desires for immediate socio-economic development from Indigenous members and the broader public, to justify the tax concessions accessed by structures? This talk will attempt to tease out some of the issues and current solutions.

Ian Murray is an Assistant Professor in the Faculty of Law at the University of Western Australia where he researches in the areas of Corporate Taxation and the intersection between Not-for-profit Law, Tax and Corporate Governance. He has a number of years' experience as a practitioner. In particular, he has been extensively involved in the taxation issues arising under native title agreements, including in relation to the benefits management structures established to hold native title payments. Ian's key current research project relates to the accumulation of income by not-for-profits.'
