Asylum in the United States and the United Kingdom: Due Process, Detention and Human Rights

This presentation will compare the rights of asylum-seekers in the U.S and the U.K., two of the most common destinations for asylum-seekers throughout the world. Professor Meili will first provide a brief overview of the rights of asylum-seekers in both countries. He will then compare policy and jurisprudence on the detention of asylum-seekers in each country, focusing in particular on recent judicial decisions which have placed (limited) restrictions on the scope of such detention. He will then present the results of his empirical research on the circumstances under which tribunals and courts in the U.K. are more likely to reference international human rights treaties in adjudicating claims for asylum.
