REFORMING SECURED TRANSACTIONS LAWS IN THE UK - INTERNATIONAL STANDARDS AND NATIONAL APPROACHES
Secured transactions are essential components of modern finance. Reforming this area of the law represents a critical item for policymakers and practitioners in different legal systems. However, this enterprise has traditionally posed relevant challenges involving a variety of legal, economic, and practical considerations. Furthermore, in a globalised economic system the coordination between national reforms and international initiatives, such as those elaborated by UNCITRAL, appears to be essential. The workshop aims at facilitating this process of coordination through a dialogue that involves national and international policymakers as well as practitioners and academics. In particular, the workshop focuses on the debate currently taking place in the United Kingdom within the international and comparative context. To this aim, the work of UNCITRAL and its impact in different legal systems will be discussed. It will follow a presentation of the existing reform projects in the UK. Finally, a discussion over possible strategies as adopted (or debated) in different European countries will be offered. The event is part of the Impact Project on the reform of secured transactions laws , sponsored by the ESRC Impact Acceleration Account (ESRC0018-2015) to foster the impact of the research conducted at University of Warwick, Law School.
