Algorithmic decision-making often involves automated processing of personal or other data to develop profiles that can be used to make decisions about people. Algorithmic decision-making advances important goals, such as efficiency and economic growth. But algorithmic decision-making also raises questions regarding fairness and fundamental rights, such as the right to non-discrimination. Zuiderveen Borgesius presents a working paper, which uses online price discrimination as an example of algorithmic decision-making. With online price discrimination, a company charges different people different prices for identical products or services, partly based on information a company has about a consumer. Some people say that such practices are discriminatory. But are they, from a legal perspective? This paper explores how discrimination law applies to online price discrimination. The paper shows that online price discrimination could lead to indirect discrimination, which is prohibited. But many algorithmic decisions that could be considered unfair are outside the scope of discrimination law.
