Ordinance 3: Officers of the University

Officers of the University

(1)

 

 

General Provisions

(a)

Except where otherwise prescribed in this Ordinance, Officers of the University will be appointed for a renewable fixed term, to be determined by the Council.

(b)

The Council will consult with the Senate on the appointment of any member of the Academic Staff as an Officer.

3.1: The Chancellor

(1)

The Chancellor will be the head of the University.

(2)

 

 

 

 

 

 

 

 

 

The procedure for the appointment of the Chancellor will be as follows:

(a)

On notice of a vacancy in the Chancellorship the Council and the Senate will establish a joint committee to consider the position and to recommend an appointment to fill the vacancy.

(b)

 

 

 

 

 

 

The joint committee will have the following members:

(i)

the Chair of Council, who will be the Chair of the Committee;

(ii)

the Vice-Chancellor;

(iii)

three independent members of the Council;

(iv)

three members of the Senate;

(v)

one professional services member of staff; and

(vi)

the President of the Students’ Union

(c)

The joint committee will invite the members of the University to submit nominations for consideration, and will make a recommendation to the Senate and the Council sitting in joint session.

(3)

The Council will, from time to time, determine the role and functions of the Chancellor.

(4)

The Chancellor’s term of office will be determined by the Council.

(5)

The Chancellor is not a member of University staff and does not receive remuneration.

3.2: The Vice-Chancellor

(1)

The Vice-Chancellor will be known as the “Vice-Chancellor and President.”

(2)

By virtue of this office the Vice-Chancellor will be a member of the Council, the Senate, each Faculty, the Board of each Faculty, each Sub-Faculty, and the Assembly, and of any committee appointed by any of those bodies, excluding the Remuneration Committee.

(3)

The Vice-Chancellor will hold office for such period and (subject to Statute 11) under such terms and conditions and with such remuneration as may from time to time be determined by the Council.

(4)

The Vice-Chancellor may suspend any student from any class or classes, and may exclude any student from any part of the University or its precincts if the Vice-Chancellor believes this may be necessary for the protection of any individual(s) or in the wider interest of the community. Such a suspension or exclusion shall be reported by the Vice-Chancellor to the Senate at its next meeting. The Vice-Chancellor may, with the informed concurrence of the Senate, refuse to admit any person as a student of the University without assigning any reason.

(5)

The Council will, from time to time, determine the powers, duties and functions of the Vice-Chancellor.

The procedure for the appointment of the Vice-Chancellor will be as follows:

(a)

On notice of a vacancy in the Vice-Chancellorship the Council and the Senate will establish a joint committee to consider the position and to recommend an appointment to fill the vacancy.

(b)

 

 

 

 

 

The joint committee will have the following members:

(i)

the Chair of Council, who shall be the Chair of the Committee;

(ii)

three independent members of the Council appointed by the Council;

(iii)

three members of Academic Staff appointed by the Senate;

(iv)

one non-academic member of staff appointed by the Council; and

(v)

one registered student of the University appointed by the Senate.

(7)

In making appointments to the joint committee, the Council and the Senate will aim to reflect diversity of experience and expertise within the University and the wider community.

(8)

 

 

The appointees of the Senate to the joint committee will not normally include more than one appointee from each of the following categories of post holders:

(a)

the serving Provost or Pro-Vice-Chancellors;

(b)

the serving Chairs of the Faculty Boards or serving Heads of academic Departments.

(9)

The joint committee will submit its recommendations in the first instance to a joint meeting of the Council and the Senate.

(10)

If the recommendations are approved by the joint meeting they will be submitted to a meeting of the Council.

3.3: The Pro-Chancellors

(1)

The Chair and Vice-Chair of Council will also be appointed to the office of Pro-Chancellor unless the Council determines otherwise.

(2)

The Council will, from time to time, determine the role and functions of the Pro-Chancellors. The Pro-Chancellors will hold office for up to five years and will be eligible for reappointment.

(3)

The Pro-Chancellors are not members of University staff and do not receive remuneration.

3.4: The Provost

(1)

The Council may, on the recommendation of the Vice-Chancellor, establish the post of Provost upon such terms and conditions and with such remuneration as the Council may deem fit.

(2)

The Council will consult the Senate on the appointment of the Provost.

(3)

 

 

 

 

 

The procedure for the appointment of the Provost will be as follows:

(a)

The Council will request that the Senate establish a search committee to act in an advisory capacity to the Vice-Chancellor on the person to be appointed to the post. The Vice-Chancellor will recommend appointment of the Provost to the Council from a shortlist provided by the search committee after the Senate has been informed of the Vice-Chancellor’s choice in the matter. In the event that the Vice-Chancellor does not wish to recommend appointment of any person recommended by the search committee additional consultation will be undertaken between the Vice-Chancellor and the search committee with a view to resolving the matter through a further process of selection

(b)

 

 

 

The search committee will have the following members:

(i)

a Pro-Vice-Chancellor who will be Chair of the Committee;

(ii)

three other professorial members of the Senate appointed by the Senate who are not serving as Pro-Vice-Chancellors; and

(iii)

an independent member of the Council appointed by the Council.

(4)

The Council will, on the recommendation of the Vice-Chancellor, determine the powers, duties, and functions of the Provost.

(5)

By virtue of this office the Provost will be a member of the Council, the Senate and the Assembly.

(6)

The Provost will normally hold office for a period not exceeding five years in the first instance, renewable for further periods not exceeding five years in each case.

3.5 The Pro-Vice-Chancellors

(1)

The Council will appoint Pro-Vice-Chancellors of the highest academic standing.

(2)

The Council will determine the number of Pro-Vice-Chancellors on the recommendation of the Vice-Chancellor.

(3)

 

The appointment of Pro-Vice-Chancellors will be made by the Council on the recommendation of the Appointment Committee for Pro-Vice-Chancellors consisting of the following:

(a)

The Vice-Chancellor, who will be the Chair of the Committee

(b)

Three members of the Senate appointed by the Senate; and

(c)

One independent member of the Council.

(4)

The appointment committee will conduct its business in accordance with procedures approved by the Council.

(5)

The term of office of Pro-Vice-Chancellors will be for such period as the Council may determine except that no Pro-Vice-Chancellor will hold office for more than seven consecutive years.

(6)

The Council will appoint Pro-Vice-Chancellors on such terms and conditions as it considers appropriate.

(7)

The Council will, on the recommendation of the Vice-Chancellor, determine the powers, duties, and functions of the Pro-Vice-Chancellors.

(8)

By virtue of this office, a Pro-Vice-Chancellor will normally be a member of the Senate and the Assembly.

3.6: The Treasurer

(1)

The Council will appoint a Treasurer of the University from amongst its independent members.

(2)

The Council will determine the period of office of the Treasurer.

(3)

The Treasurer will, in an honorary capacity, perform such duties as may be determined by the Council.
