New Book: ‘Trust, Courts and Social Rights’ by Dr David Vitale

Dr David Vitale has recently published a new book titled 'Trust, Courts and Social Rights: A Trust-Based Framework for Social Rights Enforcement'.

This book contributes to the contentious debate in the comparative constitutional law literature on how courts should enforce social rights, examining this area of law from the novel perspective of public trust in government or "political trust". It uses scholarship on trust from various disciplines to develop a trust-based framework that courts globally can employ when enforcing social rights. Under this framework, courts aim to promote the trustworthiness of government actors vis-a-vis their provision of social goods and services to the public, helping to create conditions under which citizens can trust their governments. By focusing on ideas of trust and trustworthiness, the framework addresses the drawbacks of existing frameworks for social rights enforcement.

About the author

David Vitale is an Associate Professor at Warwick Law School and holds law degrees from the UK (London School of Economics and Political Science), the US (New York University) and Canada (Osgoode Hall Law School), and a degree in psychology (University of Toronto). He has also worked as a judicial clerk in Canada and Israel, held various research positions globally and practised as a litigator in Canada.
