UK 850 MHz Solid-State NMR Facility Intellectual Property Policy

Definitions

“Facility” means the UK 850 MHz Solid-State NMR Facility.

“User” means the Principal Investigator allocated use of the Facility for a particular time period for the purpose of recording Data and nominated associated researchers.

“Data” means all time-domain NMR data, NMR spectra and associated metadata including pulse programs, parameter sets and instrument logs recorded by the User at the Facility using the Bruker Avance III 850 MHz solid-state NMR spectrometer and associated Bruker Topspin software.

“Intellectual Property (IP)” means all intellectual property rights including, without limitation, copyright, patents, trade marks, registered designs, data, software, know-how and any other intellectual property rights whether registered or unregistered, and including the right to apply for and obtain relevant intellectual property rights and protection in relation thereto.

“Background IP” means any intellectual property made available to the User by University of Warwick through the use of the Facility but not generated by the User in the course of or as a consequence of his/her use of the Facility.

“Foreground IP” means any intellectual property generated by the User in the course of or as a consequence of his/her use of the Facility.

Policy

1. Intellectual Property Rights

a. All Background IP is and shall remain the exclusive property of University of Warwick as owner of the Facility or, where applicable, the third party from whom its right to use the Background has derived.

b. All Foreground IP arising from the Facility shall belong absolutely to the user, as shall the right to apply for and obtain relevant intellectual property rights and protection in relation thereto.

2. Data Security

a. Data will be stored and archived in a secure manner in a repository managed and maintained by the Local Management Team.

b. Data can be accessed by the user using a password provided by the Facility Manager.

c. Privileged access to research data is granted to the User for a period of 18 months after the date of acquisition.

3. Data Publication

a. The Facility actively encourages publication of Data. The publication of research carried out at the Facility is one of the criteria applied when considering future applications from users for time.

b. A condition of their use of the Facility, users are required to acknowledge the Facility and funding sources in all publications which present data recorded at the Facility. Users will be reminded of RCUK/EPSRC’s expectations of Open Access Publishing.

c. The Facility and the University of Warwick will not publish Data without the permission of the user.
